Duckworth v. Watsonville Water & Light Co.
California Supreme Court
158 Cal. 206, 110 P. 927 (1910)
- Written by Curtis Parvin, JD
Facts
S.J. Duckworth (plaintiff) owned land adjoining Pinto Lake through marriage to Flora McKinlay Duckworth. The McKinlay family had previously deeded their riparian-water rights to Watsonville Water & Light Co. (the water company) (defendant). The water company diverted water from the lake to sell to nonriparian landowners. Duckworth began irrigating his land with water from Pinto Lake. A dispute arose, and Duckworth brought a quiet-title action to confirm his right to divert water from the lake.
