Facts
Terri Dudley (plaintiff) injured herself while boarding a commercial airplane. Dudley filed a federal-court suit against Beech Aircraft Corporation (Beech), Business Express, Inc., Concord Commercial Corporation (CCC), and Marketing Corporation of America (MCA) (defendants). Beech built the airplane. Business Express selected and operated the airplane. Both CCC and MCA handled the financing of the airplane. CCC held title to the airplane and leased it to MCA, which then subleased the airplane to MCA’s subsidiary, Business Express. Neither CCC nor MCA played any role in selecting or operating the airplane, which remained in Business Express’s sole possession at all relevant times. CCC and MCA moved for summary judgment against Dudley’s charges of negligence, strict tort liability, and breach of implied warranties.
