Facts
Duncan, et al. (plaintiffs) brought a class action lawsuit against the State of Michigan (defendant), alleging that the state’s system of providing counsel for indigent defendants violated those defendants’ Sixth Amendment right to effective counsel. The lower court denied the state’s motion to dismiss. The state appealed, arguing that the proper method for the plaintiffs to obtain relief is through criminal appeals.
