Facts
Dupre (plaintiff) was staying in a hotel owned by Maryland Management Corp. (defendant). Dupre initiated an altercation with a bellboy, Jones, who tried to avoid a physical fight before ultimately punching Dupre to defend himself. The blow incapacitated Dupre, after which Jones made no further use of force. Dupre sued. The trial court found that Jones had used excessive force and was liable in damages to Dupre. The New York Supreme Court granted certiorari.
