Facts
Durant (plaintiff) presented a subdivision plan for approval by the planning board of the Town of Dunbarton (defendant). The planning board denied approval of Durant’s subdivision plan. As grounds for its denial, the planning board cited concerns over the disturbance of natural waterways, possible septic system issues resulting from a high water table, and concerns about visibility at highway entrances. Durant petitioned for review of the planning board’s decision. The trial court upheld the board’s decision. Durant appealed.
