Facts
Arthur Flemming (defendant), the secretary of health, education, and welfare, promulgated a new rule under the Federal Food, Drug, and Cosmetic Act that removed several artificial food colors from the harmless list. Dyestuffs and Chemicals, Inc. (plaintiff) sued, arguing that it was entitled to a hearing on the new rules.
