Facts
Joshua Dyett (defendant) leased several rooms in a house from John Pendleton (plaintiff). Pendleton brought prostitutes into the portions of the house remaining in his control, which caused a great deal of noise at night. As a result of the disturbance, Dyett was forced to leave the property. Pendleton subsequently sued Dyett for nonpayment of rent. The trial court ruled in favor of Pendleton, and Dyett appealed.
