Facts
Clark & Sullivan Constructors, Inc. (C&S) (plaintiff), a general contractor, was awarded a contract to perform electrical work for the University Medical Center in Las Vegas. In submitting its bid for the contract, C&S relied upon a subcontractor bid made by Dynalectric Co., Inc. (Dynalectric) (defendant), who had pledged to perform the work for $7,808,983.00. After C&S was awarded the contract, Dynalectric repudiated its bid. C&S found three replacement subcontractors to perform the work for $10,310,598.00. C&S thereafter brought a promissory estoppel claim against Dynalectric. The district court ruled in favor of C&S and awarded it $2,501,615.00, which was the difference between the cost of the work performed by the replacement subcontractors and the cost of the work that would have been performed by Dynalectric.
