Facts
The Camden Housing Authority contracted with the Delaware River Port Authority (DRPA) to build a mass-transit terminal for the operation of the DRPA’s trains. The DRPA was a bi-state agency covering New Jersey and Pennsylvania. The DRPA’s creation was approved by Congress as required for bi-state agencies. The DRPA’s charter did not consent to single-state jurisdiction, save for certain specifically identified subject matter. New Jersey state law required certain barrier-free designs to assist in accessibility for handicapped individuals. The New Jersey Department of Community Affairs (NJDCA) attempted to unilaterally impose this requirement on the DRPA. This imposition was challenged, and the trial court held that the NJDCA had the unilateral authority to impose the New Jersey law on DRPA. Eastern Paralyzed Veterans Association, Inc. (plaintiff) appealed.
