Facts
Eaton (plaintiff) sued Harold Bass and the Hoover Motor Express Company (the company) (defendants) for wrongful death damages arising from an automobile accident. Bass drove the company truck that collided with Eaton. Eaton alleged the truck's defective brakes caused the accident. At trial, the company shop foreman testified that the shop routinely inspected its trucks and made necessary repairs before sending them out on the road. The foreman did not know what inspection the truck in question received, if any. The jury found in favor of Bass and the company. Eaton appealed to the United States Court of Appeals for the Sixth Circuit, arguing that the judge erred in admitting the foreman's testimony.
