Facts
Clarence Een (plaintiff) was in a car accident with a truck owned by Consolidated Freightways (Consolidated) (defendant). Een sued Consolidated for his injuries. At trial, there was a factual dispute regarding the side of the road on which the accident occurred. Consolidated called police officer John Holcomb to testify as an expert witness. Holcomb had over 17 years of experience investigating car accidents. Holcomb testified over Een’s objection that in his opinion the impact occurred on the west side of the road, which was the side on which the Consolidated truck was driving. The jury returned a verdict for Consolidated. Een moved for a new trial.
