Facts
A petitioner (plaintiff) challenged the validity of the 1961 federal elections, arguing that Schleswig-Holstein was divided into one too many election districts relative to the population The petitioner asserted that the extra election district gave the Christian Democratic Union (CDU) three additional seats. The petitioner argued that each state was entitled to only the number of representatives warranted by its population. On appeal, the Bundestag, the German federal parliament, refused to consider the challenge. The petitioner appealed to the Federal Constitutional Court to consider the implementation of the electoral system under the Basic Law.
