Facts

The State of Georgia (defendant) enacted a law prohibiting sex-reassignment surgery and hormone-replacement therapy for the treatment of gender dysphoria in transgender children. The state claimed an interest of protecting children’s physical and mental well-being and regulating medical treatment of minors. Emma Koe (plaintiff) was the mother of Amy, a transgender girl with gender dysphoria. Amy’s physician recommended hormone therapy. Koe sued the state, challenging the law on the ground that it violated Amy’s right to equal protection. Koe sought a preliminary injunction to enjoin the state from enforcing the law. The state presented evidence that risks from the treatment included fertility impairment, bone-density issues, high blood pressure, and weight gain, among others. Koe presented evidence that the treatment had the benefits of reduced anxiety, reduced suicidality, and reduced depression.
