Facts
Cascade Town Company (Cascade) (plaintiff) owned a tourist resort located along Cascade Creek. Cascade had hotels, cottages, waterworks parks, and trails. Cascade relied on the creek for the aesthetic beauty of its waterfalls as well as to support the water needs of the resort. Empire Water & Power Company (Empire) (defendant) was a hydroelectric power company that wanted to divert water upstream on Cascade Creek to generate electric power. Cascade sued for an injunction to block the diversion. The trial court granted the injunction, and Empire appealed.
