Facts
Entron, Ltd. (plaintiff) filed suit to enforce a maritime lien on the Crane Vessel Titan 5 (Crane) (defendant). The Crane responded that it was an instrumentality of Russia and was thus immune to suit under the Foreign Sovereign Immunities Act even though it was engaged in purely commercial activity. Specifically, the Crane pointed to a provision of the act that seemed to require a foreign state to explicitly waive its immunity to attachment.
