Facts
The nonprofit Environmental Defense Fund, Inc. (EDF) petitioned the United States Environmental Protection Agency (EPA) for the immediate suspension and cancellation of all registered uses of two pesticides: aldrin and dieldrin. The EDF also suggested that safer alternatives to aldrin and dieldrin were available for use. The EPA administrator declined to approve an order for suspension. This decision was based on the EPA’s conclusion that the pesticides posed no imminent hazards. However, rather than analyzing the positive benefits of aldrin and dieldrin, the EPA merely recited the pesticides’ uses. The EDF petitioned the United States Court of Appeals for the District of Columbia Circuit for review of the EPA’s refusal to order a suspension.
