Facts
The Food and Drug Administration (FDA) (defendant) promulgated an amendment prohibiting it from acting solely on the basis of environmental considerations. Specifically, the regulation limited the FDA’s power to only those acts administered by the FDA, such as the Food, Drug, and Cosmetic Act. Environmental Defense Fund, Inc., sued, arguing that the FDA also had to consider the National Environmental Policy Act when making its decisions.
