Facts
Arkay, Inc. was a federally funded entity that supplied free job coaches to employers that hired disabled individuals. The job coaches provided assistance to the disabled employees. Arkay contracted with Hertz Corporation (defendant). Pursuant to the contract, Hertz hired two mentally disabled individuals, Donald Klem and Kenneth Miller. In exchange, Arkay supplied two job coaches to Hertz. Klem and Miller were responsible for picking up trash in the Hertz parking lot. The job coaches provided full-time assistance to Klem and Miller, specifically assisting them in the performance of their job duties. There was evidence demonstrating that Klem and Miller would need this kind of assistance on a permanent basis. After the job coaches were found kissing each other, Hertz terminated its contract with Arkay. Hertz also fired Klem and Miller. Later, Arkay submitted a complaint to the Equal Employment Opportunity Commission (EEOC) (plaintiff). The EEOC subsequently brought suit, contending that Hertz violated the Americans with Disabilities Act (ADA). Hertz filed a motion for summary judgment. The district court took the motion under advisement.
