Facts
Robert Grant was a member of the Karuk Tribe (the tribe) and worked for the Karuk Tribe Housing Authority (the housing authority) (defendant). Grant filed a complaint with the Equal Employment Opportunity Commission (EEOC) (plaintiff) alleging that the housing authority discriminated against him based on his age. The EEOC investigated the complaint and, as part of the investigation, issued the tribe a subpoena. The tribe refused to comply with the subpoena, asserting that the Age Discrimination in Employment Act (ADEA) did not apply to the Tribe. The EEOC filed a petition in federal court to enforce the subpoena. The district court granted the petition. The tribe appealed.
