Facts
Larry Dilligard, a Black man, filed a complaint with the Equal Employment Opportunity Commission (EEOC) (plaintiff). Dilligard alleged that he had been denied employment by Sherwood Medical Industries, Inc. (Sherwood) (defendant) because of his race. The EEOC issued a reasonable-cause determination, finding that Sherwood did not hire Dilligard because of his race. The reasonable-cause determination stated that Sherwood excluded Blacks, particularly Black men. The EEOC later engaged in conciliation negotiations with Sherwood. At the negotiations, the only subject discussed was Dilligard’s race-discrimination claim. After negotiations failed, the EEOC brought suit in federal court, contending that Sherwood violated Title VII of the Civil Rights Act of 1964 (Title VII). The EEOC alleged that Sherwood engaged in race discrimination, as well as sex discrimination against men. Sherwood filed a motion to dismiss the EEOC’s sex-discrimination claim.
