Facts
The Equal Employment Opportunity Commission (EEOC) (plaintiff) filed a sexual-harassment lawsuit on behalf of Joanie Zupan and Tara Strahl against Simply Storage Management, LLC (defendant). EEOC alleged that both Zupan and Strahl suffered mental and emotional distress because of the alleged sexual harassment. During the discovery process, Simply Storage served discovery demands on EEOC for (1) all photographs and videos posted on Zupan’s or Strahl’s social media accounts; and (2) copies of Zupan’s and Strahl’s full social media profiles, including posts, messages, status updates, comments, and all other activity. EEOC objected to Simply Storage’s demand for social media data, arguing that the demands were overly burdensome, irrelevant, and intruded on Zupan’s and Strahl’s privacy. Simply Storage countered, arguing that the social media information was relevant to determining Zupan’s and Strahl’s mental and emotional health within the time period relevant to the sexual-harassment allegations. The disputed discovery demands were addressed at a discovery conference.
