Facts
Marian Erdelyi (plaintiff) sued Bradley Lott (defendant), a financial advisor, for fraud. The trial judge instructed the jury to compare the parties’ fault so that damages could be apportioned, and the jury found for Lott. Erdelyi appealed, arguing that the Wyoming comparative-fault statute, although applicable in cases involving negligence, should not be applied in cases involving intentional torts such as fraud.
