Facts
Grande Ronde Lumber Co. (Grande Ronde) (defendant) owed Erickson (plaintiff) payment for accounting services. While the debt was still outstanding, Stoddard Company (defendant) purchased all of the assets and assumed all of the indebtedness of Grande Ronde. Erickson sued both Grande Ronde and Stoddard in a single action for payment. Defendants were adjudged liable. They sought a rehearing of the case on the grounds that Erickson could sue only one of them, not both.
