Facts
Robert Button created a revocable trust naming his mother, Audrey Burg, as beneficiary. Burg died before Button, but the trust did not account for such a contingency. Burg died intestate leaving two sons, Button’s brothers, Kerry and Fredric. Button died 13 days after Burg. The Old National Bank of Washington (plaintiff), trustee, filed an action to determine the proper disposition of the assets of the trust. The court of appeals determined that the gift in the trust lapsed. Kerry and Fredric appealed.
