Facts
Harry Coffee died. In dispensing with Coffee’s estate, the probate court issued an order granting Coffee’s wife one-half of the couple’s community property, without making any deductions for Coffee’s debts, estate-administration expenses, or inheritance tax. The probate court imposed an inheritance tax on the other half of the community property. The California State Controller appealed, arguing that the entirety of the community property was subject to debts, administrative expenses, and inheritance tax.
