Estate of Elizabeth Beck
Pennsylvania Supreme Court
19 A. 302 (1890)
- Written by Sean Carroll, JD
Facts
Elizabeth Beck (testator) left her stepdaughter, also named Elizabeth Beck (Beck) (defendant), a one-fourth interest in her estate, upon the express condition that the inheritance not be attached or seized by Beck’s creditors. Upon the testator’s death, Beck’s creditor attached Beck’s share in the estate. The trial court held that the attachment was invalid due to the terms of the testator’s will and ordered the executor to transfer the interest to Beck. Beck’s creditor appealed.
