Facts
Michael Ettinger, a 12-year-old boy, died after falling into an unfenced pit at an archaeological site located near a playground in Jerusalem. The estate of Ettinger (the estate) (plaintiff) sued the Company for the Reconstruction and Development of the Jewish Quarter (the company) (defendant), which the estate and Michael’s family claimed were responsible for Michael’s death. As part of the action for damages, the estate sought punitive damages against the company. The district court denied the award of punitive damages, and the estate appealed.
