Facts
Joseph Hanreddy died testate and domiciled in Illinois. Hanreddy’s widow was appointed executrix of his estate in a probate court in Illinois, where claims for more than $50,000 were filed against the estate—whose assets did not exceed $4,000. Thereafter, Hanreddy’s widow was appointed executrix in ancillary proceedings in a probate court in Wisconsin, where the deceased’s assets exceeded $50,000. Resident and nonresident creditors filed claims in Wisconsin in amounts that exceeded the assets in Wisconsin. Some creditors also filed claims in Illinois. The Wisconsin probate court denied the widow’s request to delay distributing the Wisconsin assets to the Wisconsin creditors pending final adjudication in Illinois and her request that the Wisconsin assets be distributed on pro rata shares among all the creditors. That judgment was appealed.
