Facts
Robert Stafford executed a will that gave his entire estate to Sandra Jean Cantwell (plaintiff). Approximately two months later, Stafford married Cantwell. The following month, Stafford died. Upon Stafford’s death, Cantwell filed the will for probate. Stafford’s children from a prior marriage (defendants) contested the will. The trial court found that Stafford’s marriage to Cantwell did not serve to revoke the will because at the time Stafford made the will, he already intended to marry Cantwell. Stafford’s children from his prior marriage appealed.
