Facts
Coren Estes (plaintiff) sued his employer, Carpenter Co. (defendant), and several coworkers, claiming that they assaulted him several times. Estes claimed that one coworker, Doug Bullock, orchestrated the attacks. To prove this, Estes offered two out-of-court statements of an unknown assailant. First, Estes claimed the unknown assailant said, “Go tell Dougie we have got him.” Estes claimed that during the second assault the unknown assailant said, “Mr. Estes, Doug Bullock has sent you a Christmas present,” and forced him to drink doxylamine. The trial court held that the two statements were inadmissible hearsay. Estes appealed.
