Facts
Prior to 2002, the European Communities (EC) (defendant) classified certain imported chicken cuts under tariff classification line 02.10.90.20, which applied to certain types of salted meat, including chicken. In 2002, the EC reclassified these chicken cuts to a different tariff classification line, 02.07.41.10, which applied to chilled or frozen boneless chicken cuts. The applicable tariff rate under this new classification was 60 percent, much higher than the previous classification. Brazil and Thailand (plaintiffs) challenged the reclassification under the General Agreement on Tariffs and Trade.
