Facts

The United States (plaintiff) challenged a restriction on beef treated with certain hormones that had been implemented by the European Communities. The World Trade Organization (WTO) Appellate Body ruled in favor of the United States and determined that the restrictions violated the Sanitary and Phytosanitary Measures (SPS) Agreement. The European Communities were given until May 13, 1999, to bring their laws into compliance. The European Communities did not do so, and the United States sought to suspend trade concessions against the European Communities as a remedy. The United States proposed using a list of goods that it would select from and impose a 100 percent tariff upon up to $202 million, which was the amount of damage from continuing the unlawful restriction as calculated by the United States. The European Communities contested the method and amount of the trade concessions, and the matter was referred to the arbitrators by the Dispute Settlement Board.
