Facts
Derek Evans (defendant), Christopher Tinch (defendant), and Jermaine Corbitt discussed plans to break into cars to steal stereo equipment. They drove around several mall parking lots for nearly an hour looking for a car to break into but left because they were being followed by a pickup truck driven by an undercover police officer. The State of Georgia (plaintiff) charged Evans and Tinch with criminal attempt to enter an automobile. Evans and Tinch were convicted. Evans and Tinch appealed, arguing there was insufficient evidence that they took a substantial step toward breaking into a vehicle.
