Facts
The Jefferson County Circuit Court issued a temporary restraining order (the order) prohibiting James Purvis (defendant) and other union members from continuing to strike and picket against The Water Works Board of the City of Birmingham (plaintiff). The strike had resulted in violence and the potential shutdown of the city’s water system. Purvis violated the order, and the court imprisoned him for criminal contempt. Purvis filed a petition for a writ of habeas corpus, arguing that the order was unconstitutional.
