Facts
On March 31, Stanley Frieson Washington (defendant) sold an undercover officer and an informant 26 grams of cocaine. About a week later, on April 6, the officer arranged for a second sale. Washington made eye contact with the officer and had another man approach and give him 28.58 grams of cocaine. Washington was indicted for trafficking cocaine for the April 6 transaction. He was convicted by jury in the trial court, and the appeals court affirmed the judgment. Washington filed a petition for review with the state supreme court, arguing that the trial court erred in not providing a jury instruction that the state (plaintiff) had to prove that Washington knew he possessed more than 28 grams of cocaine to be found guilty.
