Facts
Exxon Co., U.S.A. (Exxon) (defendant) was charged with polluting the air in Baytown, Texas, as a result of emissions from its refinery located there. The company was convicted of air pollution and appealed, claiming that the trial court erred by overruling Exxon’s motion to quash the information. Exxon alleged that the information was defective because it failed to allege a culpable mental state.
