Facebook, Inc. (Facebook) (plaintiff) was a prominent social-networking website. Teachbook.com LLC (Teachbook) (defendant) was a social-networking website aimed at teachers. On its website, Teachbook marketed the website as an alternative to Facebook in response to schools prohibiting teachers from maintaining Facebook accounts. Facebook had multiple United States Patent and Trademark Office registrations. Facebook sued Teachbook, alleging trademark infringement and trademark dilution on the grounds that Teachbook was trading on Facebook’s fame and loyal user base. Teachbook moved to dismiss Facebook’s complaint for failure to state a claim upon which relief could be granted on the grounds that the only similarity between the two websites was the suffix “-book” and that Facebook had not alleged a likelihood of confusion.
