Family Planning Act Amendment
Poland Constitutional Tribunal
Decision dated 28 May 1997 (K. 26/96) (1997)

- Written by Kelly Simon, JD
Facts
In Poland, abortion was available throughout the country in the 1960s and 1970s. After the end of communism, abortion access became highly contested. The Family Planning Act allowed women to obtain abortions in limited circumstances. In 1996, the Family Planning Act was amended and expanded the circumstances in which a legal abortion could be obtained by allowing a pregnant woman experiencing challenging personal and living situations to have an abortion. The amendment was challenged as an unconstitutional violation of the right to life of a fetus.
