Facts
A husband and wife signed a prenuptial agreement, agreeing, among other things, to waive any right to the other’s property in the event of a divorce. In addition, at the husband’s insistence, the couple agreed to have sexual intercourse no more than once per week. The couple filed for divorce. The husband claimed that the wife breached the sexual-intercourse agreement by seeking intercourse three times a day. In addition, the husband claimed that the wife waived any right to alimony with her property waiver in the prenuptial agreement. The trial court awarded the wife alimony. The husband appealed.
