Facts
The Federal Trade Commission (FTC) (plaintiff) ordered Sinclair Refining Company (Sinclair) (defendant) and several other refiners to cease the practice of leasing pumps to retail dealers at discounted prices on the condition that the equipment be used exclusively to dispense gasoline supplied by the lessor. The FTC found that these arrangements violated the Federal Trade Commission Act (FTC Act) and the Clayton Act. Four circuit courts of appeals set the orders aside. The FTC sought review of the judgments of the circuit courts of appeals.
