Facts
Francis Feider (defendant) and his brother, Andrew Feider, owned adjoining lands. The brothers signed an agreement granting Andrew the right of first refusal to purchase Francis’s parcel should Francis ever sell. After Andrew’s death, Francis sold his property to Karl and Bertha Hecht (defendants) without first offering to sell the property to Andrew’s children (plaintiffs). Andrew’s children brought suit seeking to enforce the agreement between the brothers and enjoin the sale. Francis asserted that he did not intend the covenant to apply to anyone but Andrew. The trial court granted summary judgment to Francis. The plaintiffs appealed.
