Facts
Peggy and Samuel Feld (plaintiffs) were tenants in a large apartment building owned by John Merriam (defendant). One night, as the Felds were parking their car in the complex’s garage, they were carjacked and kidnapped. The Felds brought a civil suit against Merriam and the apartment complex, alleging that, as landlord, they had a duty to keep the Felds and other tenants safe. The jury returned a verdict for the Felds. The superior court affirmed. Merriam appealed.
