Facts
The French parliament amended the electoral code for municipal elections to require that no more than 75 percent of the candidates listed by a party for an election could share the same sex. The amendment was intended to guarantee that at least 25 percent of the candidates for local elections would be women. By setting a threshold requirement of 25 percent for women’s participation, the amendment intended to improve gender diversity in politics. Members of the French parliament (plaintiffs) referred the provision to the France Constitutional Council.
