Facts
Skrupa (plaintiff) was in the debt adjusting business and filed suit in federal district court to challenge the constitutionality of a law of the state of Kansas (defendant) that imposed an absolute prohibition on engaging in the business of debt adjustment except as an incident of the practice of law. The district court found that the law violated the Due Process Clause of the Fourteenth Amendment. The state petitioned the United States Supreme Court for review.
