Facts
Ferguson (plaintiff) was hired by Paramount Pictures to write the screenplay for Beverly Hills Cop II. The Writers Guild of America credited Ferguson as co-screenwriter and credited two other writers for the story. The membership agreement for the Writers’ Guild of America, West (Writers Guild) (defendant) requires members to submit disputes to arbitration. Ferguson instead filed a petition of mandate in the superior court to compel the Writers Guild to grant Ferguson sole screenplay credit and sole story credit. The superior court denied his petition and Ferguson appealed.
