Fermata International Melodies, Inc. (Fermata) (plaintiff) owned the copyrights to songs that were played on a specific night in the restaurant of the Champions Golf Club in Houston. On the night in question, 21 club members, plus guests, were present. Fermata brought a copyright-infringement action against Champions Golf Club, Inc. (Champions) (defendant) and its president, Jack Burke, Jr. (defendant) in the United States District Court for the Southern District of Texas. Both sides moved for summary judgment.
