Facts
Beale struck Ferrer and cracked Ferrer’s skull. Ferrer brought suit against Beale and recovered monetary damages for his injuries. Since the conclusion of that suit, a piece of Ferrer’s skull came out of his head. Ferrer brought suit again to recover for the additional injury he suffered. The lower court found in favor of Beale. Ferrer appealed.
