Facts
Michelle La Rochelle (plaintiff) was playing ping-pong at work at Del-Mar Scientifics, Inc. (Del-Mar) (defendant) during a paid break when she injured her back. Del-Mar provided the ping-pong table for employees to use during breaks, and the employer set rules for the location of the ping-pong table and when it could be used. La Rochelle filed a workers’-compensation claim, which was denied. La Rochelle then filed suit against Del-Mar and its workers’-compensation insurance carrier, Fidelity & Guaranty Insurance Underwriters, Inc. (Fidelity) (defendant). The trial court found that La Rochelle’s injury was compensable, and Fidelity appealed.
