Facts
Fielding (defendant) was charged with driving with a suspended license. One of the elements of the crime is that the defendant drives on a “highway.” The trial court instructed the jury that “[i]t is clear” that the road Fielding drove on was a highway. The jury convicted Fielding. He appealed on the grounds that the jury was improperly instructed.
