Facts
The state (plaintiff) charged Keith Filmore (defendant), a Black man, with assaulting a convenience store manager, a White woman. Before trial, Filmore’s attorney moved to question prospective jurors about potential racial bias. The state opposed the motion, arguing that voir dire already included a standard question about potential bias against the state or defendant and that the defense should not be permitted to inject race when it is not an issue. The trial court denied the motion. Filmore was convicted and appealed.
